<p>After a long time, the last December I managed to organise a real down-on-the-road trip (by train) getting to the Netherlands and northern Germany, in places I have never visited before, except one: Berlin, where I&#39;ve been once 15 years ago.</p>
<p>It was that kind of journey I always long for, just travelling on local trains, watching people and places. And what a nice feeling to meet also people I know living in many different places. That was what gave me the most of the whole trip, that was a real fun everyday everywhere I have been!</p>
<p>I got to Amsterdam by plane and then started to travel by train making my way through most of the main towns in Holland, and then I shifted to to visit the winter markets (and not only) of many German towns. All the way to Berlin, which I have to mention separately.</p>
<p>I&#39;ve been just once in Berlin before, in the summer of 1995, and I really have to say i couldn&#39;t recognise it, so much it has changed after all these years. Still, the atmosphere is so particular, I couldn&#39;t avoid to get involved in the night life, full of people at any time. Without much chaos, it looked also quite safe, a big town where maybe life is not that bad, after all.</p>

			<content:encoded><![CDATA[<p><a href="http://commons.wikimedia.org/wiki/Image:Scale_of_justice_2.svg" title="Scale of Justice"><img src="/images/Scale_of_justice_2.png" align="right" /></a>Non mi piace parlare di politica. Cercherò dunque di attenermi ai fatti.</p>
<p>Ci sono state non poche lamentele nelle ultime settimane per un  <a href="http://www.governo.it/Presidenza/DIE/doc/DDL_editoria_030807.pdf">disegno di legge sull&#8217;editoria</a> presentato dal <a href="http://www.governo.it">Governo Italiano</a> riguardante anche le pubblicazioni su internet quali blog e forum (in linguaggio legislativo, &#8220;<em>qualsiasi prodotto contraddistinto da finalità di informazione, di formazione, di divulgazione, di intrattenimento</em>&#8220;, art. 2, par. 1 della legge sopra citata), richiedendo per tutti la registrazione in un registro nazionale e anche la nomina di un direttore responsabile.</p>
<p><span id="more-324"></span>  Un po&#8217; tutti si sono lamentati, e la cosa ha avuto molto risalto sui media, dove si è parlato di pericolo della libertà di parola. Difatti il Governo si è scusato per la poca comprensibilità della legge, e l&#8217;autore ha promesso di modificare l&#8217;Articolo 7 aggiungendo un paragrafo in cui si dice &#8220;<em>Sono esclusi dall&#8217;obbligo di iscrizione al Roc i soggetti che accedono ad internet o operano su internet in forme o con prodotti, come i siti personali o ad uso collettivo che non costituiscono un&#8217;organizzazione imprenditoriale del lavoro</em>&#8221; (ho trovato <a href="http://www.zeusnews.it/index.php3?ar=stampa&amp;cod=6339&amp;numero=907">questa fonte</a>, ma nessuna dichiarazione ufficiale sul sito del Governo) .</p>
<p>Ora, a parte il fatto che &#8220;<em>organizzazione imprenditoriale del lavoro</em>&#8221; è un po&#8217; incomprensibile anche per un amante delle lingue come me, suppongo il punto sia escludere blog e affini dall&#8217;obbligo di registrazione e di nomina di un direttore. Però si capisce poco.</p>
<p>Cercando ulteriori informazioni, sono finito sul sito internet <a href="http://www.freedomhouse.org/">freedomhouse.org</a>, un&#8217;organizzazione no-profit che mantiene una <a href="http://www.freedomhouse.org/template.cfm?page=251&amp;year=2006">mappa della libertà di stampa</a> con commenti per ogni nazione e classificati per anno. Ecco che nel rapporto sulla <a href="http://www.freedomhouse.org//modules/publications/pfs/modDisplayCountryDetail2.cfm?country=6737&amp;year=2005&amp;page=16&amp;view=mopf">libertà di stampa in Finlandia nel  2005</a> leggo:</p>
<blockquote><p>Una nuova legge sulla libertà di stampa, preparata con suggerimenti dai media, è stata approvata a gennaio. In base ad essa tutte le pubblicazioni, includendo siti internet come blog e liste di discussione, devono nominare un direttore responsabile e mantenere in archivio il materiale pubblicato per almeno 21 giorni.</p></blockquote>
<p>Häh? Ma è praticamente uguale al disegno di legge italiano! Ed è già in vigore! Ho dovuto cercare ulteriori informazioni, visto che il mio blog è su un server in Finlandia. Andando alla pagina sulla <a href="http://www.freedomhouse.org//modules/publications/pfs/modDisplayCountryDetail2.cfm?country=6963&amp;year=2006&amp;page=16&amp;view=mopf">libertà di stampa in Finlandia nel  2006</a> si legge già qualcosa di diverso:</p>
<blockquote><p>Dal 2004, non è più richiesto il <em><a href="http://it.wikipedia.org/wiki/Log">logging</a></em> del traffico internet, e i gruppi di discussione online vanno al di là dello scopo della legge. Comunque, le pubblicazioni su internet devono avere un direttore responsabile e mantenere in archivio il materiale pubblicato per almeno 21 giorni.</p></blockquote>
<p>Ancora più confusa &#8216;sta storia. Ora si parla di &#8220;pubblicazioni su internet&#8221;, l&#8217;anno  prima di &#8220;tutte le pubblicazioni, includendo siti internet come blog e liste di discussione&#8221;.</p>
<p>La soluzione più naturale è stata andare a leggere la legge, e scoprire così che le informazioni citate sopra sono rispettivamente <strong>sbagliate</strong> (2005) e <strong>ingannevoli</strong> (2006).</p>
<p>La legge finlandese a cui si fa riferimento è &#8220;<a href="http://www.finlex.fi/fi/laki/ajantasa/2003/20030460">Laki sananvapauden käyttämisestä joukkoviestinnässä 13.6.2003/460</a>&#8220;, ovvero &#8220;Legge riguardo l&#8217;uso della libertà di parola nella comunicazione di massa 13.6.2003/460&#8243;, dove effettivamente all&#8217;articolo 4 si legge:</p>
<blockquote><p> 4 § <strong>Vastaava toimittaja</strong></p>
<p>Julkaisijan tulee määrätä aikakautiselle julkaisulle ja verkkojulkaisulle vastaava toimittaja.[...]</p></blockquote>
<p>che in italiano vuol dire</p>
<blockquote><p> 4 § <strong>Direttore responsabile</strong></p>
<p>L&#8217;editore deve nominare un direttore responsabile per periodici e periodici elettronici.[...]</p></blockquote>
<p>Ma allora è proprio così? Non esattamente, non per tutti. La soluzione del mistero è nell&#8217;articolo precedente, dove sta scritto:</p>
<blockquote><p>3 § <strong>Soveltamisala</strong></p>
<p>Tätä lakia sovelletaan Suomessa harjoitettavaan julkaisu- ja ohjelmatoimintaan.  Yksityisen henkilön pitäessä yllä sähköisen viestintäverkon kotisivua häneen sovelletaan vain 12, 14, 16, 18, 19, 22 ja 24 §:ää.[...]</p></blockquote>
<p>cioè</p>
<blockquote><p>3 § <strong>Ambito di applicazione</strong></p>
<p>Questa legge si applica a tutte le pubblicazioni e gli spettacoli prodotti in Finlandia.  Ad una persona privata che mantenga pagine su una rete di comunicazione elettronica si applicano solo gli artt. 12, 14, 16, 18, 19, 22 e 24.[...]</p></blockquote>
<p>Cioè, in pratica l&#8217;articolo 4 si applica solo a imprese che hanno giornali su internet (tipo quotidiani elettronici) e non a singole persone che hanno un blog o mantengono un forum.  Due lezioni, dunque:</p>
<ul>
<li>freedomhouse.org deve specificare che il direttore responsabile non è richiesto nel caso di blog o comunque siti internet mantenuti da singoli privati</li>
<li>Il Governo Italiano può copiare la legge finlandese. Molto probabilmente scriveranno alla fine qualcosa di simile, molto più ingarbugliato, usando un sacco di risorse, spendendo un sacco di soldi, e facendo arrabbiare un sacco di gente che pensa che la loro libertà di espressione sia messa in pericolo dallo Stato.</li>
</ul>
<p>Io personalmente non ci credo. Forse perché presumo buona fede. In ogni caso sono d&#8217;accordo con l&#8217;articolo pubblicato su questo tema da <a href="http://technology.timesonline.co.uk">Times Online</a>, e intitolato &#8220;<a href="http://technology.timesonline.co.uk/tol/news/tech_and_web/the_web/article2732802.ece">A geriatric assault on Italy&#8217;s bloggers</a>&#8220;, ovvero &#8220;Un attacco geriatrico ai blogger italiani&#8221;, dove il termine <em>geriatrico</em> la dice tutta.</p>
<p>Se al Governo Italiano interessa la mia proposta di copiare la legge finlandese, posso aiutarli nella traduzione: <a href="/contact">contattatemi pure</a>, costo molto meno di un <em>consultant</em> italiano, lo prometto!</p>

			<content:encoded><![CDATA[<p>I was lately wondering how worth it is for the UK to keep their own currency instead of switching to the euro. That is, apart from patriotic reasons, is it really worth it?</p>
<p>I&#8217;ll leave this as an open question, since I&#8217;m not expert in economy. But I&#8217;m a good nerd: so I got the currency exchange rates from 1.1.2002 to 18.5.2007 and plotted the values in euro of 1 British pound during this period:</p>
